Hereafter referred to as the Hirer 

And 

London Performance Studios CIC

Hereafter referred to as the Venue

1. Term of Hire

1.1 The Hirer agrees to be clear of the space hired by the pre-agreed time on each day of hire, including all props, sets, equipment and personal property 

1.2 The hire is a private hire with the hirer managing their own staffing and covid measures.  

1.3 For the avoidance of doubt, there cannot be public access, unless agreed in writing in advance.


2. Payment

2.1 The total Hire Fee will be agreed by both parties before securing the booking.

2.2 In order to secure the dates of the booking, the Hirer will need to make a non refundable deposit of 50% paid upfront.The Hirer agrees to pay the full remaining amount at least 24 hours before the start of their booking time.

2.3 There is no extra charge for payments made via bank transfer / BACS. For payments made via card there will be a payment charge applied to the agreed amount as set the card payment provider.


3. The Venue’s Obligations

3.1 Provide, in suitable condition, access to the Hirer for the dates agreed in advance.

3.2 Provide, in suitable condition, any equipment agreed upon in advance of the Hire commencing


4. Hirer’s Obligations

4.1 Provide any additional equipment necessary.

4.2 Ensure Covid regulations are adhered to.

4.3 Ensure that all current Health and Safety Legislation is adhered to, that all its agents are properly trained in the use of any equipment that may be necessary and that all materials and equipment brought into the venue are flame proof, PAT tested and of a first class standard.

4.4 Be liable for any physical damages, legal actions, and/or loss of reputation or business opportunities that the Venue may incur as a consequence of the actions of the Hirer or any of the Hirer’s crew while the Hirer is in control of the Venue, and shall indemnify and hold harmless the Venue against any and all legal actions which may arise from the Hirer’s use of the Venue.

4.5 Use its best efforts to maintain the Venue in the condition it was in at the commencement of the term of hire, subject to usual wear and tear.

4.6 Allow the Venue and its employees, agents and licensees all reasonable access to the Venue.

4.7 Inform the Venue immediately on the Hirer becoming aware of any breakages or damage to the Venue or its fittings or fixtures and pay for any damage or loss suffered by the Venue that is caused by the negligence of the Hirer

4.8 Return any keys to the Venue at the end of the term of hire.

4.9 Not attach in any way to walls, doors, glass, floors, furniture or fittings in or around the Venue any nails, screws, adhesive tape, signs or other items without the prior consent of the Venue.

4.10 Not serve or consume alcoholic beverages on the premises.

4.11 Not interfere with or alter any of the electric installations, lighting of other technical equipment owned by the Venue.


5. Control & Protection

5.1 The Venue reserves the right to control access to the premises for the  protection, accommodation and convenience and for the fulfilment of all obligations, terms and conditions relating to the hire or additional operations of London Performance Studios.


6. Mutual Responsabilities

6.1 The Venue shall be responsible for such insurance cover against all risks in respect of:

→ Its property and that for which it is responsible
→ Its employees 
→ The Hirer shall be responsible for such insurance cover in respect of all risks in respect of
→ Their property and that of their company arising out of their use and occupancy of  the Hirer
→ Their company 
→ Their crew 

7. Access

7.1  Hirers will have private access for the time and date they space hire for. 

7.2 Other areas (kitchen, corridors, toilets) of the building will be communal and shared with others.

7.2 There is parking option available on the site but Parking cannot be guaranteed.


8. Refund Policy

8.1 The Hirer must give the Venue a minimum of 30 days notice should they wish to cancel the hire. If 30 days notice is given, the Hirer shall receive all sums paid to the Venue less the non-refundable deposit paid. 

8.2 If the Hirer wishes to cancel the Hire with less than 30 days notice, the Hirer shall receive a credit on their account valid for 3 months for use to re-book the Hire for alternative dates. This credit can only be used to re-schedule once.


9. Serving of Notices

9.1 All notices, documents, or information which either party is required to give to the other shall be in writing to London Performance Studios, U33 Penarth Centre, London SE15 1TR or any address substituted therefore and either: 

→ delivered personally
→ sent by registered or recorded or like post
→ or emailed

Any such notice or other such communication shall be deemed to have been properly given:

→ where delivered personally, upon delivery
→ where sent by registered or recorded or like post, 3 business days after posting; or
→ where emailed, upon delivery of a read receipt. 


10. Fire Safety

10.1 While in occupation of The Venue, The Hirer will be temporarily responsible for fire safety during the period of agreed occupation.

10.2 The Hirer holding any public-facing event is responsible for arranging an induction with the London Performance team. 

10.3 The Venue agrees to introduce The Hirer (holding a public event/ meet) to the safety measures in place to detect and fight fires, The Hirer will take all reasonable measures necessary to prevent fires from occuring during the occupation period.

10.4 The Hirer must review and understand evacuation procedures and will be responsible for anyone entering the hired premises during occupation.

10.5 The Hirer will ensure any activities undertaken in the space are not a fire risk, or where a risk of fire is presented a risk assessment will be carried out and submitted to London Performance Studios CIC with no less than 48hrs notice and all risk assessments will be reviewed and signed off before undertaking proposed fire risk.

10.6 The Hirer agrees to ensure that any props or equipment brought into the space are not a fire hazard, and are not considered to be at risk of exploding.

10.7 The Hirer will ensure that the property is left in a safe condition, this includes but is not limited to; ensuring any devices are unplugged (including charging cables), all socket switches are in the off position, nothing is blocking any fire exits or any means of ingress and egress, lights are switched off, heating is turned off, doors are closed (and locked where appropriate).

10.8 The Hirer agrees that they are competent, and understand the risks associated with fire safety. The Hirer agrees to all terms stated in Clause 10 of these conditions and will adhere to them completely.
